General conditions of the Nista language centre

 

 

 

I. INTRODUCTION

The general conditions of operation define the rights and obligations of the performer of services Nista d.o.o. (from now on: performer) and of the client (from now on: client) and define the manner, the content and the conditions of operation.

The general conditions are an elementary part of every contract, offer or subscription.

II. ADVICE MEETING AND ENTRY TEST

Every new student has to come to an advice meeting on telephone or at the school and, if necessary, also the entry test available on our website www.nista.si or at the school.

III. PAYMENT CONDITIONS

Payment conditions for physical persons:

The student is bound to pay the course material and the first instalment of the course – €100 of pre-payment (it is part of the total cost of the course). The rest of the cost has to be paid at the beginning of the course in due date. The student is bound to pay the course according to the conditions in the pricelist.

Payment conditions for legal persons:

Legal persons are bound to present an order form and pay the cost of the course before the beginning of it in one instalment to Nista’s current account: TRR 10100-0032377625, opened at the bank Banka Koper d. d. Cost for course material is not included in the price.

In case of delay in payment, the performer has the right to delay interests.

In case the student is late with at least one instalment, the performer sends a warning and sets a new due date for payment. If the student misses to pay also after the warning, the performer can demand the complete sum.

Cost for course material is not included in the price.

IV. TYPE OF PAYMENT

The course and material costs can be paid:

  1. in cash at the headquarters,
  2. via e-banking,
  3. monthly instalments:
    1. cheques – all the instalments need to be paid before the end of the course (cheque issue dates: 1st, 15th and 30th day of the month)
    2. Nista’s instalments free of interest (3–6 instalments, it depends on the duration of the course).

SALES

Students can get one of the sales types for a single course:

  • 5% for pre-subscription between June 15 and 30
  • 5% for a second family member
  • 10% for a third and every other family member
  • 5% for contemporary subscription to two or more courses (it is valid for the second course)
  • 5% for high-school students, university students and retired

V. STUDENT’S WITHDRAWAL

The subscription to the course means that the student filled in the entry form, agreed with the general conditions and pay the pre-payment in the sum of €100. The withdrawal from the course is possible only in case of illness that lasts for more than 30 days proved by medical certificate. In such case the student has to pay administrative costs in the sum of €25, whereas pre-payment is completely refunded to the student.

VI. STUDENT’S CANCELLATION

The student can cancel the course only by writing to the office and only because of illness that last for more than 30 days proved by medical certificate. In such case the students has to pay the cost of the course (calculated until the day of written cancellation) and administrative costs in the sum of €25. In any other case the student has to pay the total cost of the course.

Other reasons, as lack of time, holidays, unexpected obligations, school obligations and similar are not accepted as reasonable and the student cannot cancel the course for these reasons.

The student cannot replace the paid course in group to the following term, but another student brought by that cancelling student can participate to the course if his/her knowledge corresponds to the group’s knowledge.

VII. CANCELLATION OF THE COURSE – INDIVIDUAL CLASSES OR INTERNAL GROUP

In case the student(s) cannot come to an individual class or internal group class, they have to communicate it to the performer at least 24 hours prior to the scheduled time or the latest at ).30 a.m. if the class is scheduled in the afternoon or evening at the telephone numbers 00386/5/62-50-400 or 00386/41/44-90-90.

In case the student does not communicate the cancellation in time to the performer, the class is supposed to be realized and the performer has the right to the cost of this class.

VIII. PERFORMER’S CANCELLATION OF THE COURSE

The school has the right to cancel individual classes or the whole course due to reasons it cannot control or do not depend on it (as for example a not sufficient number of students). Students are refunded (without interests) every hours cancelled by the school. Students can also use the paid money for other courses.

IX. STUDENT’S OBBLIGATIONS

The student has to:

  • pay the course according to the general pricelist conditions/offer,
  • pay the course material,
  • communicate cancellation to the performer in case of illness of more than 30 days proved by medical certificate and pay the course costs until the end of the current month and administrative costs in the sum of EUR 25.

X. TYPES OF EDUCATION

Besides individual classes, twin and triplet courses, at Nista we offer also:

  • Micro groups of 4 to 6 students and
  • Macro groups of 7 to 12 students

Students can join Nista’s courses every Monday. In case the group changes from a micro to a macro group and if all the students agree, the other students can receive a Nista voucher (in the sum of the price difference caused by the change from a micro to a macro group), that students can use for the following course.

If the student was absent (was late because of late subscription):

  • in the first two hours of the course, he/she has to pay the total cost of the course,
  • in the first four hours of the course, he/she has to pay the whole cost of the course and has the right to a free individual hour,
  • in the first five or more hours of the course, he/she has to pay only the attended classes of the course.

XI. COURSE ATTENDANCE CERTIFICATE

The student receives the certificate if he/she:

  • concluded a 44-hour-course
  • attended at least 80% of the program
  • is present to the final test and
  • paid the cost of the course.

XII. CONCLUDED LEVEL CERTIFICATE

The student receives the certificate if he/she:

  • concludes a language level according to the European standards (from A1 to C2)
  • successfully passes the final exam (more than 61% of correct answers)
  • paid the cost of the course.

XIII. PERSONAL DATA PROTECTION

The performer is bound to protect personal data according to the personal data protection law. Personal data will be used only for the aims of the contract and for information material, offer, invoice sending and other necessary forms of communication.

XIV. FINAL PROVISIONS

Slovene jurisdiction is applied to all rights, obligations and responsibilities among the contracting parties that are not defined in the contract or in the general conditions.

The parties will solve eventual disputes arising from the contract or connected to it in a friendly and peaceful way. In case this is not possible, it is competent the Court of Koper.
